The Framework Act on the Development of Artificial Intelligence and the Establishment of a Trust Foundation, also known as the AI Framework Act, will take effect on January 22nd of next year. South Korea is the second country to enact AI-related legislation, following the European Union, but will be the first in the world to implement it. The controversy stemmed from the claim that labeling requirements could apply even to cases where AI was used for auxiliary purposes. Concerns are raised that if labeling is required simply because AI was used in some aspects of the production process, such as color correction or image quality enhancement, the costs of compliance with social regulations could increase. Furthermore, the very fact that AI was used could negatively impact consumer perception.<\/p>\n\n\n\n
If the AI Basic Act passes the National Assembly plenary session, AI providers like OpenAI and Naver will be required to provide the technical foundation and guidance for users to apply watermarks when creating synthetic images or videos. Foreign AI companies operating in Korea will also be required to designate a domestic agent authorized to communicate with the government. Technologies related to human life or physical safety will be classified as high-impact AI, allowing the government to require measures to ensure safety and reliability.<\/p>\n\n\n\n
In the event of a violation, the Minister of Science and ICT can issue a corrective order and impose a fine of up to 30 million won. While the industry supports the goal of preventing deepfake crimes, it points out that an excessively broad regulatory scope could burden service competitiveness and the creative environment.
